VFW Post 11447: February 2007 Meeting Minutes

Post Commander Correll called the meeting to order at 1000 on Wednesday, 14 Feb 2007.

There were 25 members in attendance.

Comrade Alvarez gave the opening prayer.

Commander led attendees in reciting the Pledge of Allegiance and Section 3 of the Congressional Charter.

The Roll Call was taken by the Adjutant and absentee noted.

Commander called for new recruits:

Commander asked if the minutes from the previous meeting had been posted:
The Adjutant reported they had, and no comments or changes had been made. Comrade Saunders made motion to accept the minutes as written, seconded by JVC Corbin. Carried.

Commander called for the report of the Quartermaster:
QM Burnett presented the report. He explained some of the expenditures. He also said that the Post General Fund had a good month with receipts about $500 over expenditures. Trustees audited the report on 12 Feb. SVC Boruff made the motion to accept the report as presented, seconded by Comrade Saunders.  Carried. The report is on file at the Post home, if anyone wants to see the report contact the Quartermaster.

PHC Report:
1. Report of Feb meeting read by PHC Chairman Cox.

The meeting was called to order on Monday, 12 Feb by Chairman Cox.

Audits and Reviews: 

  • Canteen end of the month inventory was done on 31 Jan.
  • Trustees audited Canteen records and funds for the month of Jan on 5 Feb.
  • PHC reviewed Canteen records and found them to be in good order.
  • PHC Chairman Cox inventoried daily draw chips on Jan 31.
Canteen Managers Report:
  • All Canteen expenses have been paid and all bills are current including Mayors permit, SSS and 13th month.
  • Sales are improving.

Membership Committee:
SVC Boruff gave report. Life Members 370, New 5, Reinstated 5, Cont 35, Total 415 members.  These are still 1 Jan figures as National has not updated membership stats; however, Quartermaster said Post membership is now at 435 with two applications in the mail.

Comrade Alvarez reported P1000 ($21) was collected for the Relief Fund.

Web Master:
One member, Fred McClure has volunteer for the position.  He lives in the states but has a computer and the time to spend on the site.  He will be here for the Beach Bash and things will be explained to him.

Comrade Alvarez led the membership in reciting the National Home Prayer.

UNFINISHED BUSINESS

Commander asked the status of a Post dart team. Comrade Sullivan said that a P2000 entry fee would be required and he is looking for four players. Will give update next meeting.

Commander explained the current situation with the Labor Board and former cook Bartolome; we are waiting for resolution from the board.

NEW BUSINESS

Commander told the membership that he received a letter from the Labor Board on the 6th of February with the resolution of a case filed against the Post Canteen/VFW by four former employees.  This was a complete surprise to the Commander and Adjutant as the previous Canteen Manger, when asked by the Commander about the status of the case said that it had been dropped. Canteen Manger resigned in September.  Labor Board decision was that the Canteen owed the four employees P373, 000 pesos ($7,800) in separation pay and back pay from date released to date of the resolution.  The reason the employees were release was that they refuse to sign an employee Code of Conduct. The Code was written after it was discussed with them at a prior meeting and the rules and penalties for infractions were explained.  No one objected at that time and when it was ready for signatures the four employees refuse to sign. The Code of Conduct stated that if any employee refused to sign they would be release from employment immediately.

In July of last year, the Labor Board sent a registered letter to the Post asking for a Point Paper to explain our side of the dispute, the Post Commander did not receive this letter as it was addressed to the Canteen Manager and apparently she never showed it to anyone and did nothing.  Since we did not respond and no other correspondence was received, the Labor Board based its decision on what the former employees told them and a similar case ruled on by the Philippine Supreme Court.

Commander and Adjutant saw a lawyer last Tuesday, 13 Feb and discussed options. He said that he would draft up a letter to the Board for a meeting with the employees and the Post.  We will try to work out a decision and see if we can get the employees to settle for less, example just separation pay not separation pay and back wages.  If they do not want to settle for less they will probably not get what was awarded as the Canteen does not have that much money and if Post property were seized to pay it, they would only get about $2000.

Commander asked the membership if they wanted the Post home to close down, no one present at the meeting wanted to close down the Post home.  Commander then explained to them a recovery plan that was prepared by Lee Andersen if we had to pay the full amount.

Both loans can be paid from the proceeds of the 2007 and 2008 Beach Bashes or from future fund raisers. Loans are interest free.

Motion was made by Comrade Saunders to accept the plan, seconded by Comrade Koeppen.  After lengthy discussion which included an amendment to the motion that the post solicit donations from members. The QM thru the authority of the Commander will paid the debt from all available sources.  Donations sent by check should be made payable to VFW Post 11447 and annotated in the lower left hand corner “Labor Board Dispute”.   Membership voted on plan of action. Carried.

Commander said that a delegate is needed to carry the Post’s delegate votes to the Department Convention.  Comrade Saunders made motion that the Commander carries the delegate votes, seconded by Comrade Koeppen. Carried.

Commander said that the error in the Post name that has not been change since the Charter was written in1992 be corrected.  The current name of the Post on the Charter and National records is “Paul P. Busik” the correct name should be Paul P. Busek.  National By-laws states that we have to notify Department and Post members 30 days before we can vote on a name change.  Comrade Mike Best made motion that the name change be voted on at the next meeting, seconded by Comrade Alvarez. Carried.  Adjutant will send letter to Department Commander advising them of the request for name change and Department will send recommendation to National. 

Commander said that nominations for Post Officers will be opened next meeting and closing of nominations and voting will take place in our April meeting.

FOR THE GOOD OF THE ORDER

Commander reminded members that a DEERS/RAPIDS ID Card Support team is on SBMA to issue ID cards, provide DEERS eligibility verification and other services.  DFAS personnel are there to provide retiree pay and beneficiary information and DFAS Point of Contact information.

Loyalty Day.  JVS Commander will make preparations for Loyalty Day Observance on 1 May.

A petition to Vietnam for accountability of all POW’s was passed around for signature.

Effective 1 Feb the NAIA Terminal Fee was increased to P750 ($16) from P550.

Commander asked that members refrain from sending non-official email to the Post.

50/50 Raffle was won by Comrade Klingensmith.  Total of P2100 ($43) was collected, P1050 to the Post and P1050 to Comrade Klingensmith.

Commander adjourned the meeting at 1120.  Next meeting will be held at the Post Home at 1000, Wednesday 14 March 2007.
